i wonder how common this is? with there being lots of small localish or region-wide scenes it would be easy to just take tracks from say, south american artists and pass them off as your own in europe. i suppose that's what he done here, thinking it would unlikely that Willem would discover his track.

it would be a good investigative story for someone on RA, just like last year there was a rash of stories about buying fake likes and fake followers. it would be a difficult story to put together though, people would be unlikely to want to share there lies.

especially since the melody was already programmed into the patch.
legally speaking I could have tried to sue the guy (unless someone else used this patch before in some track, in which case that person could legally sue me),
but I felt like it would only make me look bad,
being the unknown techno/ambient producer that I am...
so what's the point, really ?

by the time I read this topic the ripped version of your track was already gone Willem, so I couldn't compare to hear how bad it was.

if you used a melody that someone else created in a sound someone else created (if i'm reading it right) then it's not really yours. things might have changed since i studied it, but as far as i was aware it is the melody that is the copyrighted material, unless something is a sample being sampled. taking a royalty free melody and processing it and someone else processing it similarly isn't really theft.
there is a Slam track 'Azure' which has a main riff made from one of the arpeggiator presets on one of the Arturia classic synths (i forget which one). someone else also used that exact riff and sound in a house track several month later.

using the same thing as someone else is different from stealing or copying someones work.

it's a good thing I name my clips after the instruments and FX I used though,
cause that way I was able to find the clip back 1,5 years after I made the soundscape and was able to find back which synth and patch I used.

since I play piano, I almost always play in my melodies myself, and almost never use preprogrammed melodies or arpeggiators (unless I made the arpeggiator pattern myself).
so I would have thought that the clip really did contain my melody (as most other parts in that soundscape did) if I wouldn't have been able to find back which synth I used.
but Metaphysikal is just a drone synth, so you can't even "play" the sounds in any normal way with a keyboard, you just go with whatever it's reproducing and start tweaking away or run it through FX...

I've got an Xpander here that's always going crazy, and if I don't start the reboot procedure while starting up, it will start playing a sound automatically.
At times I just love to use whatever it's producing and start from there.
